"... Obama's political handlers decided to cauterize The Donald sideshow with a nifty piece of political choreography..."

"...releasing the 'long-form' birth certificate the very day Trump was wooing voters in New Hampshire."

Says The Daily News, crediting Obama with brilliant timing. Given the pro-Obama slant to the article, the poll in the sidebar over there has 74% of poll-takers saying the "birther" controversy is not over. Screen cap, just now:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

That is the relevant admission by Obama that he is not a natural born Citizen. He was born w/ allegiance to Britain.
If the well known reason for the natural born requirement is to reduce foreign influence, how can one born British be eligible?

Who did Obama "release" the "Long from" to? Did he release it to a Court? NO. Did he release it to Congress? NO. It is simply a pic on the internet, and proof of NOTHING. What court of law admits a pic on the internet as evidence?

Regardless, Obama birth as a British subject already excludes him from eligibility. He is not a natural born Citizen.

Founder John Jay wrote to George Washington, then Presiding Officer of the Constitutional Convention, on July 25th, 1787:

“Permit me to hint, whether it would be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American Army shall not be given to nor devolve on, any but a natural born Citizen.”

That letter proves that the very reason for the requirement of natural born Citizen was to prevent foreign influence. So how could it be possible that one born British, with allegiance to Britain be a natural born Citizen?

I'm amused by the whole thing.

What's especially chuckle-worthy is the number of people marveling at "how the controversy stays alive" who were, six and ten years ago, part of the shouting crowd demanding More documentation! Reveal it all! No, a Presidential order isn't enough! Something must still be hidden!

If you are one of the ones howling that (a) George W. Bush had to be documented back to the Flood and (b) Barak H. Obama's bare word is good enough, you're just part of the comedy act.

Ric

Alexander Hamilton first proposed that the requirement for POTUS should be "BORN A CITIZEN". He was overruled in favor of "NATURAL BORN CITIZEN". Here in Federalist #68 he explains the reasoning behind the natural born Citizen requirement:

"Nothing was more to be desired than that every practicable obstacle should be opposed to cabal, intrigue, and corruption. These most deadly adversaries of republican government might naturally have been expected to make their approaches from more than one querter, but chiefly from the desire in foreign powers to gain an improper ascendant in our councils. How could they better gratify this, than by raising a creature of their own to the chief magistracy of the Union? But the convention have guarded against all danger of this sort, with the most provident and judicious attention."

The most "provident and judicious attention" to the prevention of foreign influence of the Chief magistrate was the natural born Citizen requirement. Natural born Citizens are born in the US of 2 US Citizen parents, i.e born w/ NO FOREIGN ALLEGIANCE. Again the reason for the requirement is shown CONCLUSIVELY to prevent foreign influence. How could it be remotely possible that one born British be a natural born Citizen, eligible for POTUS? IT IS NOT POSSIBLE that Obama is eligible, no matter if norn on the Oval Office desk.

So Obama's political handlers let this fester for 2 years so they could spring their trap on... Donald Trump?

I merely suppose he's as smart as Ted Kennedy, who was expelled from Harvard for cheating in his sophomore year.

At prep school Ted's hardpartying ways and mediocre grades made his brother JFK refer to Ted as "the gay illiterate."

Obama sprung the trap too late (allowing it to build and take a life of its own) or too early, by not letting Trump force other GOP candidates to declare on the issue.

By deflating Trump some, he leaves more air time for other GOP possibles

It's the NBA fiinals, the big games are on the line, we want all our home players to be peaking because their performances really count now, and...
Kobe or LeBron makes the big move, producing his college graduation certificate to show us all that, yes indeed, he IS qualified to play in the Bigs.

(Yes, I know you don't need a college degree to play in the NBA like you need to be an American to be voted in as President, but run with me here?)

Anybody who thinks this is some "Big Victory" for President Obama and his administration are missing the point. Busy looking behind, instead of concentrating on the games being played today, and most importantly, looking ahead to the future challenges.

I'm not a Donald Trump fan (didn't he go bankrupt a few times for all his business success?) but I'm sorta sad at the way Team Obama has played this one.

I just hope -- pray, really -- that this type of "divide and conquer" racial mentality isn't just a harbinger of what's to come in 2012. Yes, he's the first black president. We get that.

Can we please concentrate now on performance -- the less superficial issues affecting us all, the country as a whole, instead of playing the race card for some cheap win? Big Victory, this ain't.

The authenticity of the Birth Certificate no longer matters. What matters is that Obama held it back for reasons he has never made clear.

And now it's really too late. The dissembling for so long has caused questions about his birthplace (easily answered) to evolve into more general, vague questions about his fitness for office (not so easily answered and not able to be dismissed with a PDF release).

You get it? How come just about all here have refused to believe these simple facts and logic for over 2 years? How come the illustrious "law prof" writer of this blog, supposedly well versed in the Constitution, has not done a piece outlining the ineligibility of Obama?

Mick said...

Obama refused to release this so called "long form" (it is an overlayed PDF file, and proof of NOTHING), and allowed the courtmartial and imprisonment of a Lt. Col. (Lakin) who refused to deploy until he saw it.

Is this the action of a legitimate CIC?

1) He's a diversity hire, not qualified for the job

2) He's not American. I don't care where he was born and raised, he's not one of us.

Obama's whole approach and demeanor have been a demonstration of one who hates America. Why shouldn't people have questioned whether he really is an American? And his unwillingness to produce a birth certificate just added to the suspicion.

A commenter over at PajamasMedia astutely noted that the question about the Birth Certificate has always been a surrogate for the question "Is he one of us?"

The release of the birth certificate does not answer that question in the affirmative, and Obama won't suddenly see the polls jump in his direction as a result.

But hey, it sure distracts from gas and food prices, doesn't it?

Brian said...

I think the Dems hope this birth certificate flap will smear the Republicans with the "birther" label. It makes Obama look better if he appears to be the one who's not promoting conspiracy theories, calm and collected, etc.

However, whoever the Republican nominee will be will be someone who never dabbled in the birther debate. Or outright said it was hooey. And in 2012 no one will care about who talked about a birth certificate in 2010 or early 2011. They'll be more concerned with gas prices, food prices, and the unemployment rate.

You only have to look at Obama to know this is true. Obama said many things on the campaign trail, and reversed himself once in office. Bringing this up now doesn't make much traction; just like the shock of the economic collapse in Sept. 2008 trumped every other issue in the last presidential election.

I don't think it's "over."

The "document" released yesterday looks to be scanned out of a bound book, trimmed, and superimposed on an official looking green patterned background to which a somewhat indefinite certification by the [Hawaiian?] State Registrar has beeen added.
Some folks already claim to have found evidence that the text in the scan has been "photoshopped." This is above my competence, but I have no doubt that the argument will go on, because this document really does not "prove" anything. Even if additional editing can be proved, it may be just that they removed some inappropriate personal comment that someone in Honolulu scribbled on the original book entry, so that the Registrar could still in good conscience certify that the official information is correct, there will still be doubts that that was all there was to it.

For me, Obama's place of birth has never been in doubt because of the newspaper announcements at that time, but if that was not good enough for some people, this "document" does not change anything.

With all of the internet looking at this, could we see an example of early 60's Hawaii birth cert where a parent is black showing that HI would say "african" when other states would have used "negro"??Anybody see an embossed seal on the document?

Obama was born a British Subject, and is not eligible.

Because a British law supposedly says so? I for one reject the idea of another country's laws overriding ours.

(I wonder what would have happened if Panama passed some kind of law declaring John McCain to be a native son - would that have messed up his 2008 candidacy?)

Tread carefully on the subject of "natural born Americans." Louisiana Gov. Bobby Jindal is the U.S.-born offspring of Indian immigrants who hadn't naturalized before his birth - good luck with telling Republicans / conservatives that Jindal is not a natural-born American.

Not an "official" birth certificate. There is no governmental seal. This document would not be acceptable

It is an abstract not the original that everyone else gets and which is EASILY obtainable.

There seems to be some proof (nebulous) that the document released as the 'long form' birth certificate has beenmanipulated in Adobe Illustrator. No governmental agency would do this or probably even have the skills to attempt this.

Whether it is a forgery or not. It is NOT an official government document.

It is almost like Obama wants to keep this controversy alive because...........SQUIRREL!!!!

It thus clearly appears that by the law of England for the last three centuries, beginning before the settlement of this country, and continuing to the present day, aliens, while residing in the dominions possessed by the crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, and the jurisdiction of the English sovereign; and therefore every child born in England of alien parents was a natural-born subject, unless the child of an ambassador or other diplomatic agent of a foreign state, or of an alien enemy in hostile occupation of the place where the child was born. III. The same rule was in force in all the English colonies upon this continent down to the time of the Declaration of Independence, and in the United States afterwards, and continued to prevail under the constitution as originally established.

They completely misread who won the battle. Barack Obama is the President of the United States of America. Donald Trump is a rich guy, TV host and wannabe politician. For Obama to be responding directly to Trump is demeaning to the office. He was punching down, and that never looks good. He should have had one of his press flacks do it. Instead, he only enhanced Trump's standing in the eyes of some people, and certainly did nothing to enhance his own.

Just like the children of 1 US Citizen and 1 alien , born abroad are US Citizens (not natural born), it also works the other was around. The Jay Treaty, between the US and Britain is still in force, and says that British Subjects are bot to be considered as Native US Citizens, but treated as such in matters of property and inheritance.
Of course Jindal is not eligible, and could break the whole thing wide open by being a statesman, and declaring that he is not eligible because of his non Citizen parents. He wouldn't have to mention Obama. Alas, their are no statesmen.

Yep. That is at the root of this timing, especially with a questionable document. Had they produced one that looked legitimate - lacking the anachronisms and errors evident in this one - the issue simply would have died. They had to present one with plausible unbelievability in order to distract us.

I don't know the ultimate answer regarding where he was born or whether he's ineligible for other reasons (e.g., having been naturalized in Indonesia), and will leave that to those with more information and time to devote to it. All I know is that he's horrible for middle class America, great for the uber-elites for whom he serves as a figure-head, and therefore not someone who should be our president, regardless of eligibility for the office.
